Entre Cila e Caríbdis: o árduo caminho do constitucionalismo sistêmico

The present thesis aims to present to the scientific community a general theory of systemic constitutionalism, starting from the analysis of the new constitutional models developed throughout the incessant process of globalization, which arises through the communicative interweaving between polycontexturality, transconstitutionalism and interconstitutionality, as an observation and relevant contribution to the new connotations of existing projections in the folding of the reflex generated by the multiple historical cultures of constitutionality under a specialized systemic unit. There is a structural and functional delimitation that is exercised within this specific systemic unit (systemic constitutionalism), which also has an autopoietic semantics of meaning. These aspects are presented throughout the present research, developing an increase in the capacity of systemic observation, in the sense in which center / periphery are (re) defined operatively, in an ultracycle of communication. The method used is the systemic autopoietic in a critical heterodox bias, thus enabling a new contemporary configuration of systemic concepts. The results demonstrate that the three systemic constitutional forms exist and are reflexive in their autopoiesis. Without the connective aspects of systemic constitutionalism they are insufficient to meet social normative expectations alone, necessitating a general theory for the interconnection of their objectives and the increase of its capacity for complexity.Nenhuma
