Abstract

The present dissertation searchs to identify, in judicial judgments that turn on the subject `environment', the existence of a inautentic pre-understanding of the operators of the Right.Implemented the Constitutional Jurisdiction and placed to the disposal legal instruments of guardianship of the basic rights, happened with the Democratic State of Right, the Brazilian Constitution and the elements of the contemporary constitutionalism, it possesss the Judiciary Power a new paper, to accomplish the substantiality of the Constitution. However, if the interpreter does not understand the constitutional commitment, not even the question of the ecological balance, collaborates in its inefetivity and, for consequence, in the increase of the ambient degradation.
