Scientific work done in order to demonstrate the importance of granting the individual its active legitimacy to file class action lawsuits, approaching themes that insert the reader into a critical analysis of Collective Procedural Law, allowing simultaneously efficient conceptual comprehension, as legal status, principles, effectiveness and procedural instrumentality, active legitimacy to file lawsuits, Collective Procedural Law as an instrument of Popular Sovereignty and the magnification of active legitimates list as a way of fostering citizenship.Collective Procedural Law s concept, legal status, historical evolution, constitutional base and
peculiar principles will be studied in this first chapter. Collective Procedural Law is analyzed through a legal and procedural general theory in the second chapter; the new classification of positive law and the species of object of protection rights. Collective Procedural Law peculiar
procedural aspects, as the judicial stoppel and active legitimacy will be approached in the third chapter, arguments in favor of the magnification of active legitimates list to include individual s legitimacy and positive consequences will be brought to end this chapter. In the fourth chapter, the analysis of comprehensive theories about pluralism deed in contemporary societies will be done; in this chapter, will be approached the concretization of public policies by Judiciary and Collective Judicial Power, through popular participation, being useful to this goal.
