Smart contracts y Blockchain en la compraventa de inmuebles futuros: ¿el fin de las estafas en la etapa preventa?

Abstract

La compraventa de inmuebles futuros en etapa de preventa presenta serias debilidades jurídicas estructurales en el Perú, al carecer de garantías efectivas sobre el uso de fondos. Este artículo propone incorporar smart contracts ejecutados en blockchain como mecanismo de auto ejecución contractual, capaz de reforzar la seguridad jurídica, asegurar hitos constructivos, mejorar trazabilidad financiera y reducir riesgos, todo ello dentro del marco normativo del derecho civil peruano.

The sale of future real estate properties in the pre-sale stage presents serious structural legal weaknesses in Peru, as there are no effective guarantees regarding the use of funds. This article proposes incorporating smart contracts executed on blockchain as a mechanism for contractual selfenforcement, capable of reinforcing legal certainty, ensuring construction milestones, improving financial traceability, and reducing risks, all within the regulatory framework of Peruvian civil law.
