| dc.description | Abstract. The doctrine of conventionality control has vague contours. The two central themes through which the main lines of conventionality control circulate are the internationality of constitutional law, and the constitutionality of international law. The aim of this paper is to discuss whether in the exercise of the conventionality control the interpretation of the American Convention on Human Rights by the Inter-American Court of Human Rights is binding on our local courts, particulary on the Argentine Supreme Court of Justice. The solution to this question is through the consistent interpretation of the law, applying the large doctrine guidelines where consensus have been set without anyserious difficulties and debates, and acknowledging that complex issues deserve above all an implementation of the normal prudence rules, at least until revealing an enduring doctrine based on the principle of legal certainty. | en-US |
| dc.description | Resumen. La doctrina del llamado control de convencionalidad tiene contornos imprecisos. Los dos ejes por los que circulan sus principales trazos son la internacionalización del derecho constitucional y la constitucionalización del derecho internacional. El objetivo del presente trabajo es discutir si en el ejercicio del control de convencionalidad la interpretación de la Convención Americana de Derechos Humanos por la Corte Interamericana de Derechos Humanos es vinculante para nuestros tribunales locales, en particular para la Corte Suprema de Justicia de la Nación argentina. La solución a este interrogante pasa por la interpretación armónica del derecho, aplicando los grandes lineamientos doctrinarios en los cuales los consensos se han consagrado sin mayor dificultad y debate, y reconociendo que las cuestiones complejas merecen ante todo la aplicación de la regla de la normal prudencia, cuando menos hasta llegar a develar una doctrina perdurable con base en el principio de seguridad jurídica. | es-ES |
