Los mecanismos de prevención de fraude en el ámbito registral respecto del registro de propiedad inmueble

Abstract

El presente estudio de investigación tiene como objetivo principal analizar los mecanismos de seguridad jurídica implementados por Registros Públicos, tales como la Alerta Registral, Inmovilización temporal de partidas, bloqueo por falsificación documentaria y los mecanismos digitales y normativos. Esto con el fin de prevenir y enfrentar a las organizaciones delincuenciales que a través de documentos falsos intentan vulnerar el sistema notarial atribuyéndose predios que no les corresponden. Para el desarrollo del presente trabajo, se ha realizado un análisis de los principales temas respecto al sistema registral. Se inicia definiendo la seguridad jurídica, desde su reseña histórica, alcances y relación con el sistema registral. Se desarrolló la noción del derecho de propiedad y su relación con el registro de propiedad inmueble. Asimismo, fue necesario hacer un desarrollo de los alcances de la Ley Nª 30313, y su relevancia en la prevención del fraude inmobiliario.

The main objective of this research is to analyze the legal security mechanisms implemented by Public Registries, such as the Property Alert, temporary immobilization of items, blocking due to forgery and regulatory mechanisms. This in order to prevent and confront criminal organizations that through false documents try to violate the notarial system by attributing properties that do not correspond to them. For the development of this study, an analysis of the main issues regarding the registry system has been carried out. We begin by defining legal security, from its historical review, scope and relation to the system. The notion of property rights and its relationship with the real property registry were developed. It was also necessary to develop the scope of Law No. 30313.
