A redução das disputas arbitrais e judiciais em face da existência da cláusula de Dispute Boards: relação entre o custo e a assimetria de informações: viabilidade de implementação em contratos de menor relevância econômica.
This paper analyzes conflict resolution using the Dispute Board arbitration clause and examines its relationship with the economic analysis of the law. The article begins with a brief consideration of Laws and Economics concepts and the economic implications consequently incurred in disputes. In view of this context, consideration is given to the asymmetrical information involved in the creation of panels formed by engineers and the lawyer. The goal is to complete the panel's work and achieve technical solutions for the disputes. Finally, consideration is given to the possibility of using the Dispute Board arbitration clause in constructing contracts with smaller economic expression.
