Atuação do município na prevenção terciária dos egressos do sistema prisional: uma análise da experiência vivenciada na cidade de Caruaru por meio do projeto Banco de Talentos durante o período de 2017 a 2019.

Abstract

This work deals with the role of municipalities in promoting public policies for tertiary prevention within the context of the constitutional right to public security proposed in the constitutional text as a duty imposed on all federal entities and universal law, highlighting the difficulties that the redesign of the 1988 federative pact presented, compromising the democratic process and reinforcing repression policies to the detriment of prevention policies, making the performance of municipalities to be secondary and that of the states and the Union gain notoriety with the police activity, whose work of constituent legislator did little or nothing to change the political, administrative and financial reality within the existing structures, hampering their performance, unlike what happens with education and health, whose functions and budget were well delineated, leaving to assume the prevention policies, however, with the political limitations. and financial aspects that the federative design imposes on it. There is also the concern to work on the theme of the punitive system, in order to include the reader in the scope of what is understood by criminal sanction and how its foundations and claims have been re-signified with the course of criminological practices and theories, conferring it has a perverse, stigmatizing and cruel face in order to establish itself as an instrument of control and neutralization of the so-called social predators, to the point of recognizing that its re-socializing function, in fact, does not exist, leaving only to deal with the factual reality of their reintegration into the social environment after serving their sentence and highlighting the importance of the work of the municipalities in primary, secondary and, above all, tertiary prevention, as in the city of Caruaru through the Talent Bank project carried out in partnership with the Penitentiary patronage of Pernambuco, whose data show a considerable participation of ex-prisoners and a reduction in criminal recidivism. Bibliographic and documentary sources were used in order to achieve the proposed objectives. As a methodological contribution, the legal-sociological research was developed, through which the need to launch into the field of investigation, take ownership of the object, understand the concepts that involve research as indispensable factors for establishing a close relationship with the data collected and with the objective of the work, drawing on the proponent of qualitative research, which provides a wealth of answers and dense elements to explain the relationships, processes and phenomena that one wishes to unveil, without failing to consider the importance of quantitative research, which was also resorted to, as one supports the other and vice versa, in the search for a serious and consolidated research.
