This dissertation consists making a critical reading of human rights today when identified paradoxes, perplexities and contradictions on practices supplanted by dominant logic of its western design. From this bias we conjecture about an urge in human rights resulting in expansion of humanist discourse and Eurocentric domination. The correlation is made between the Western expansionism and universalism of human rights. From the perspective of decolonialism it is questioned the project of modernity in order to understand that Eurocentrism and colonial expansion were essencial to the formation of a practical sense of human rights nowadays. And so was proposed analysis of human rights in its colonial feature still present in its priority role in the end of Western history according to humanitarian practices. Therefore it became imperative to highlight the relationship between power and moral to understand the recent history of the West path and in the same way the scope of human rights in our global order. The hypothesis is human rights takes on a global dimension while it has a specific locus of production as the production of knowledge in European epicenter and imperialist tradition of the West were crucial to its universalism. Thus the reflection lies with sovereign exercise and violent practices in current scenario as it‟s understood social control through selective legitimacy manifested under universalism. In the course of this work was observed violence manifested in the name of human rights and categorized production of knowledge which defines the constitutive view of human. In this way is justified the measurement of prevailing narratives in statements of modernity law and corresponding violence within constitutional framework. Also was necessary to pay attention to power relations commonly disregarded without which the current conception of human rights could not be conceived. The intention is to reveal the humanitarian standards and production of knowledge as human rights are established as moral substrate to today's dominant practices. On the other hand decolonialism is opposed to progress of historical linearity guided by success of Western civilization. What set out to do from genealogy of craft when questioning modernity and human rights in search for alternatives to our current model of society. For this it is mentioned the importance of promoting pluralism in production of knowledge, professing openness to diference and resisting dominant practices. In this way the epistemological perspective implies in reversal of the role of human rights with modification of its theory and practice. The research was a joint of critical theories in particular with the convergence of decolonial perspective and the critique of human rights universalism. Moreover despite the theoretical character prevail in this work were analyzed historiographical accounts and recent political events. From what had been stated is sought to think a critical exercise of human rights in opposition to Eurocentric discourse and its institutionalized validation.eng
