This thesis aims to carry out an analytical investigation of the possibilities of formulating new perspectives to confront domestic violence against women in Brazil and Portugal from the habermasian thought of communicative action in the context of contemporary Brazilian and Portuguese constitutionalism, between 1970 and 2018. It is, therefore, a matter of discussing theoretical proposals capable of leading to possible guidelines common to Brazil and Portugal that are capable of paving future public policies in these countries aimed at tackling domestic violence against women. Thus, the research seeks to problematize in which aspects the confrontation to domestic violence against women in Brazil and Portugal can be improved through the communicative construction of common guidelines to these countries in the context of contemporary Brazilian and Portuguese constitutionalism between 1970-2018. The hypothesis that is confirmed at the end of the research is that the process of dialogic decantation based on Habermas is able to enable the construction of common guidelines between Brazil and Portugal with a view to tackling domestic violence against women in these countries; as well as this hypothesis also serves to pave the way for a future and possible formulation of public policies in the countries in question, maintaining the objective of facing domestic violence against women. The methodology used to achieve the proposed objective includes the method of inductive approach, the historical-comparative procedural method and the research technique of direct and indirect documentation with bibliographic research relevant to the topic.Nenhuma
