dc.description.abstractThe aim of the dissertation is to identify which artificial intelligence (AI) projects are being developed by the Court of Justice of the State of Rio Grande do Sul, it aiming to build a document that can help the Court to implement artificial intelligence mechanisms in the first degree of jurisdiction, especially in civil courts , which respects the fundamental rights of the parties to the use of algorithms in the decision-making process, so as not to derogate from the constitutional functions of the judges for the machines. The research brings together elements to answer the following question: “To what extent have the current AI projects in the TJRS observed the constitutional principles involved in the judicial decision-making process?”. The technology revolution is a striking element of the new times. It is known that today society is inserted in what Klaus Schab calls “Fourth Industrial Revolution”, where, daily, new technologies are presented to society with the premise of bringing you greater convenience and speed. One of the most prominent technologies within this scenario is artificial intelligence, capable of performing tasks that previously could only be performed by a human being. However, it is within the scope of the Judiciary that AI has generated intense discussions among researchers in the area, due to the possibility of transferring the power to issue a judicial decision to machines. The debate becomes relevant since there are numerous AI-based initiatives that are already being used by the Brazilian Courts. In order to achieve the proposed objective, the inductive method was used, with the techniques of documentary bibliographic research and non-participant observation. The conclusion of the research indicates the need to observe the constitutional principles in the construction of an environment for artificial intelligence that is safe and centered on the human being.en
