dc.description.abstractThe scope of this work is to demonstrate the relationship of the offense to the principle of minimum intervention in the face of the expansion of Criminal Law, more precisely, about the emergence of new legal assets. Thus, firstly it is studied the principles of reason within the legal dogmatic, seeking to rationalize the overcoming of legal positivism before the neoconstitutionalism, according to which the Constitution must be understood in its normative power, in a true sense of what the Constitution is. Next, it is intended, within this path, to conceptualize the principle of minimum intervention, which follows, therefore, the constitutional law, whereas the criminal law will be expanded, amongst the causes, through the emergence of new legal assets. Thus, it is necessary to consider this dialectic in order to demonstrate the antagonism of these findings, which are glimpsed in todays penal world.en
