Abstract

This paper discusses the possibility of building new perspectives for the collective protection of social rights of workers, in the process. Search from overcoming the liberal-rationalist paradigm recognize new conditions of possibility for the realization of social rights, contextualized in a democratic state. In this environment research is developed recognizing the changing role of the judiciary that is commitment to solidarity with other public entity acts as director of public social policies, from the figure of the judge who has enhanced the creative role from Carnellutti. It recognized a new era in the collective protection proved to be adequate to solve the problems of mass and for the most diverse wishes of society itself postmodern.
