The main sources of Colombian law maintain that autonomous patrimony formed in the development of commercial trust contracts don’t enjoy legal personality, however this maxim doesn’t seem to be congruent with the treatment of the figure nor with the normative development involving the trust, where it’s implicitly that they are treated as a true subject of rights with a certain degree of independence from the trustee. The article reviews the origins of the trust up to the adoption of the term "autonomous patrimony" with the issuance of the Code of Commerce, showing how some legal provisions subsequent to said Statute have been referring to the autonomous patrimony as a subject with its own capacity, just as the most recent jurisprudence has done in the 21st century. The article reflects on the causes that explain this phenomenon and the effects it may have on the trustee's liability, as well as presenting a critique of the same.
