| dc.description | Social rights create legal conditions that are necessary so that a
person‘s dignity is safeguarded and
everyone is allowed to exercise
his or her freedoms and to develop his or her personality. In spite
of this, social rights had not been recognized by law until relatively
recent times, and, even after being legally recognized, they were
ineffective becaus
e there were no legal actions that allowed a
person to demand their enforcement. In this essay, we will consider
the importance of social rights and their historical evolution. We
will also analyze the most suitable and recent techniques of
protection that
have been created in different jurisdictions in order
to guarantee the respect of these rights, whose absence annuls in
practice the efficacy of the entire set of fundamental rights. | |
| dc.description | Los derechos sociales consagran posiciones jurídicas imprescindibles para que la dignidad de la persona sea salvaguardada y todo individuo alcance la situación que le permita ejercer sus libertades y desarrollar su personalidad. Pese a ello, estos derechos han sufrido una completa falta de reconocimiento jurídico hasta etapas históricas relativamente recientes, y posteriormente una privación de eficacia real a pesar de ser formalmente reconocidos, debido a la falta de vías para exigirlos ante la autoridad. En el presente artículo reflexionaremos sobre la relevancia de los derechos sociales, su evolución histórica y las técnicas de protección más adecuadas y recientes que han sido elaboradas en diversos ordenamientos para garantizar el respeto a unos derechos cuya ausencia anula en la práctica el vigor de todo el arco de derechos fundamentales. | |
