| dc.description | El objetivo de este trabajo fue determinar la noción de justicia digital, examinar las implicaciones negativas y positivas de la implementación de un modelo de justicia digital por la pandemia del Covid 19 y establecer los retos de su implementación. Para ello, se desarrolló la investigación a través del método deductivo mediante el estudio y análisis de distintos marcos normativos, con un enfoque metodológico cualitativo, el cual se sustenta en fuentes doctrinales como Devis Echandía y Hernán Fabio López blanco. Como resultado, se logró determinar la imposibilidad de establecer una noción estricta de justicia digital, puesto que esta concepción se estructura a partir de herramientas, principios y garantías propias de cada legislación, de tal manera que teniendo en cuenta nuestro contexto, los marcos legales vigentes hasta antes de la pandemia del Covid 19 se encontraban lejos de ser justicia digital. Por ello, la pandemia del Covid 19 fue la oportunidad para dar paso a la justicia digital, sin embargo, para lograrlo uno de los grandes retos que se debe afrontar es esencialmente lograr dotar a administradores y auxiliares de justicia con los elementos electrónicos, técnicos y estructurales necesarios para que eficazmente cumplan sus funciones e implementen de manera óptima la justicia digital. | |
| dc.description | The objective of this work was to determine the notion of digital justice, to examine the negative and positive implications of the implementation of a digital justice model for the Covid 19 pandemic and to establish the challenges of its implementation. For this purpose, the research was developed through the deductive method by studying and analyzing different normative frameworks, with a qualitative methodological approach, which is supported by doctrinal sources such as Devis Echandía and Hernán Fabio López Blanco. As a result, it was possible to determine the impossibility of establishing a strict notion of digital justice, since this conception is structured because of tools, principles and guarantees specific to each legislation, so that considering our context, the legal frameworks in force until before the Covid 19 pandemic were far from being digital justice. Therefore, the pandemic of Covid 19 was the opportunity to give way to digital justice, however, to achieve this, one of the great challenges that must be faced is essentially to provide administrators and auxiliary justice with the electronic, technical, and structural elements necessary to effectively perform their functions and optimally implement digital justice. | |
