If we start from the idea according to which, in order to receive rights and obligations, the recognition of a certain legal personality by the social conglomerate to which one arrives is needed, then the situation of "irregularity" is proposed as a zone of "no law" , a factual impossibility (not belonging to the system of norms) that prevents normative recognition. Indeed, this type of situation linked to migration policies does not find a consistent response from the so-called Universal Human Rights System, nor from other Regional Human Rights Systems that determine in themselves who -legal status- is the Irregular Migrant and, contera, what rights are attributable to him by virtue of that legal status awarded. For this reason, each State has had to choose to take its own definition due to the inexistence of a universally agreeable concept of consequence, a study is necessary that, through the problematization of cases, registers the normative advance taken and severely analyzes the advancement of the concept in the different human rights subsystems (European and Inter-American Regional System).
