| dc.description | Chile is part of the phenomenon of Environmental Constitutionalism developed in the Latin American region, so its Political Constitution contemplates the right of people to live in an environment free of pollution and establishes duties for the State regarding the Law and the protection of the environment. However, this formula has proved to be deficient, which merits a rethinking of environmental issues at a constitutional level. This work follows this path from the study of the projects of constitutional reform currently before the National Congress, with the aim of systematizing analyses at the service of a change that will be the basis for an adequate environmental legal framework, respectful of human rights and that will maximize the protection of the environment. | |
| dc.description | Chile es parte del fenómeno del Constitucionalismo Ambiental desarrollado en la región latinoamericana, así su Constitución Política contempla el derecho de las personas a vivir en un medio ambiente libre de contaminación y establece deberes para el Estado en torno al Derecho y la protección del medio ambiente. Sin embargo, dicha fórmula ha resultado deficiente, lo que amerita replantear las cuestiones vinculadas al medio ambiente a nivel constitucional. Este trabajo recorre esta senda a partir del estudio de los proyectos de reforma constitucional que se encuentran actualmente en el Congreso Nacional, con el propósito de sistematizar análisis al servicio de un cambio que sea la base para un marco jurídico ambiental adecuado, respetuoso de los derechos humanos y que maximice a la protección del medio ambiente. | |
