The principle of protection to the weaker spouse was recently joined by Chilean law, so through this work we try to move forward on the content and scope of the same, considering the need that the judge gives him content in the concrete case, basing its resolutions. In addition, the different mechanisms of protection of the spouse that is weak in the new law on civil marriage are herein analyzed, such as the right to financial compensation, the so-called clause of hardness and the judicial approval of the regulatory agreement, reviewing the main legal, doctrinal and jurisprudential sources existing to date. | en-US |
| dc.description | Resumen.El principio de protección al cónyuge más débil fue incorporado recientemente por la legislación chilena, por lo que a través de este trabajo intentamos avanzar en su contenido y alcance, planteando la necesidad de que el juez le dé contenido en el caso concreto, fundamentando sus resoluciones. Además, se analizan los distintos mecanismos de protección del cónyuge débil en la Nueva Ley de Matrimonio Civil, como son el derecho a compensación económica, la denominada cláusula de dureza y la aprobación judicial del convenio regulador, revisando las principales fuentes legales, doctrinarias y jurisprudenciales existentes hasta la fecha. | es-ES |
