| dc.description | In this work I will carry out a special study of the object of usufruct, addressing the usufruct of law, and with greater epistemology, the usufruct of credit (if it has or not, consonance with the general theory of usufruct of law). This approach is motivated by the need for a special treatment of the usufruct of the right of credit, given the absence, lack, or lack of interest that it has for the doctrine (of some countries). I believe - and I am convinced - that something evidently escapes the science of law, and the doctrine, by ignoring a topic that has a certain autonomy and its own qualities such as the usufruct of rights and more specifically the usufruct of the right of credit if this is possible. precision or "change of function". | dc.description | En este trabajo realizaré un especial estudio del objeto del usufructo con direccionamiento al usufructo de derecho, y con mayor epistemología, al usufructo de crédito (si tiene o no, consonancia con la teoría general del usufructo de derecho). Motiva este abordaje la necesidad de un especial tratamiento del usufructo de derecho de crédito dada la ausencia, carencia, o poco interés, que reviste para la doctrina (de algunos países). Creo -y me voy convenciendo- que algo evidentemente escapa a la ciencia del derecho, y a la doctrina, al ignorar un tópico que presenta cierta autonomía y cualidades propias como es el usufructo de derechos y más específicamente el usufructo de derecho de crédito si cabe esta precisión o “cambio de función”. Asumo como camino para despejar los interrogantes iniciar un desarrollo que comprenda el estudio de las fuentes del derecho romano, como así también la civilística actual argentina y comparada pretendiendo llegar a premisas mayores que permitan un juicio de valor acerca de las instituciones objeto de la presente tesis, buscando las variables de conflicto susceptibles de esbozar una teoría general y una serie de axiomas claves para el tratamiento de una nueva dogmática impuesta por la civilística gestada por el nuevo ordenamiento civil y comercial de la República Argentina. | es-ES |
