| dc.description | According to article 431º of the Argentine Civil and Commercial Code, “The spouses commit themselves to develop a common life project based on cooperation, cohabitation and the moral duty of fidelity. Mutual help should be given.” Therefore, we are faced with a new regulation that distinguishes between legally-specific rights-duties and a moral right-duty: the duty of fidelity. On his behalf, the Argentine legal doctrine, discusses if the duty of fidelity, besides to its moral character, would be legal or if it is a strictly moral duty and therefore, would not generate any kind of legal effects.

| dc.description | Conforme al artículo 431º del Código Civil y Comercial argentino, “Los esposos se comprometen a desarrollar un proyecto de vida en común basado en la cooperación, la convivencia y el deber moral de fidelidad. Deben prestarse ayuda mutua.” En este sentido, nos encontramos frente a una nueva regulación que diferencia entre derechos-deberes propiamente jurídicos y un derecho-deber moral: el deber de fidelidad. Por su parte, la doctrina jurídica argentina, discute si además de su carácter moral, el deber de fidelidad, tendría carácter jurídico o si se trata de un deber estrictamente moral y, por tanto, no generaría ninguna clase de efectos jurídicos.
Por otro lado, si la regulación del deber de fidelidad en el CCyC es indubitablemente moral, ¿Cuál (es) son/es la(s) razón (es) de tan controvertidas interpretaciones? ¿El deber de fidelidad tiene carácter estrictamente moral, tiene carácter moral y además jurídico?
