dc.description.abstractThe thesis analyzes the relationship between democracy and jurisdiction in order to understand the legal decision-making process beyond the realm of legal positivism. To this end, this work intends to show that legal experience must take into consideration cultural aspects of rights with a decisive contribution from philosophical hermeneutics as well as the bond that should exist between legal texts and their cultural context. In order to bring about a different perspective on the principle of human dignity as a "cultural anthropological premise" the work will comment "the underlying cultural crystallizations" which binds legal texts and the cultural context. As such, contributions from philosophical hermeneutics are presented to show that every hermeneutical situation must be examined considering both intersubjectivity and man´s insertion in the world according to his understanding of truth, enabling correct answers on issues of law and democracy.
